The case has reached the Ontario Superior Court of Justice, with Oxford's lawyers arguing that Fairweather's presence could deter other prospective tenants and diminish Yorkdale's overall value. They claim to have been working on reducing Fairweather's brands across their shopping centers in Ontario and Alberta.

Fairweather, however, has a different story. They argue that Ailes will bring substantial retail experience and expertise, positioning itself at a higher price point than their other brands. Their lawyers, led by Orestes Pasparakis, state that Fairweather is creditworthy and experienced, and they are already in the process of opening Ailes department stores in Quebec.

A Precedent for Yorkdale?

Retail analyst Bruce Winder believes that having Fairweather in Yorkdale's biggest space could alter the mall's perception. He emphasizes the importance of brand and price point image, stating, "You can't mess that up."

Winder draws parallels to the Ruby Liu case, where a B.C. billionaire's attempt to take over Hudson's Bay leases was thwarted due to concerns over her business plan and inexperience. He suggests that the Ruby Liu case may have set a precedent for this battle.
